Drug testing of physicians would not have prevented the deaths that supposedly sparked the drive for Prop 46. The CURES program referenced in Prop 46 has been in existence for several years and has been useless. And even if it were functional it would add an excessive time burden to each doctor's practice. The MICRA cap has kept insurance expenses to a level 1/4th that of states that don't cap pain and suffering awards. The cap does not preclude larger awards when the suit can claim and prove negligence. There are a number of counties in New York and other un-capped states that don't have OB-GYNs because of prohibitively high insurance premiums. Quadrupling the cap will quadruple the premiums which will force many solo and small group practice physicians out of business. Only large companies that receive tax preference subsidies like Kaiser and Sutter will be able to remain profitable. County and other teaching hospitals will face bankruptcy as a result of what will be prohibitively high insurance premiums.
