The East Bay Express, Schaaf, and Kernighan should get their facts straight. First, the independent corporations that run Subway and Jamba Juice at the airport have always paid their workers the Oakland Living Wage, even though they are not required to do so since they are exempt under the law. Secondly, these independent corporations are in no way "part of [the] large corporation[s]" that they pay franchise fees too. If we are going to respect the corporate form in this country (and the Supreme Court has said that the corporate form should be respected even to the extent that a corporation can be said to have "free speech rights" and the "right of religious expression") then there is no reason to ignore the corporate form for these small businesses just because it happens to affect the wages of some workers. Just because corporation A pays license and other fees to corporation B for the use of its name and other benefits does not make corporation A part of corporation B.
