Very frustrating.

The CEQA argument is intriguing. But is that moot given that railways are regulated by the Federal Government?

Once the coal arrives in the Port of Oakland wouldn't it then fall under State & Local jurisdiction...as well as CEQA?

Even if the Feds regulate the railways, their impact or potential impact on the adjacent community should not be.

1. Whether the rules are blurry or not "Jenkins concluded in his report that Oddie had violated 7.3 when he urged Keimach last year to hire a specific candidate for Alameda's fire chief". It seems the EB Express is letting Oddie off kind of lightly by focussing only in passing at Oddie's violation of the City Charter. This makes the EB Express appear biased.

It doesn't absolve Keimach but you're focussing almost exclusively on her while barely covering what Oddie has done wrong.

2. How could independent investigator Michael Jenkins decide not to listen to the tape yet without it make a determination that the 2 Councilmembers were absolved of any wrong doing?

Furthermore if the tape reveals they were doing something illegal, then the tape is NOT illegal. Either way, we won't know until either we hear the tape or the results of the Alameda County District Attorney's investigation.

Shouldn't we hold off on conclusions until that is complete & all the facts are known?

At a January Planning Commission meeting re a project to build a hotel in West Oakland, City staff told the planning commission they were not able to implement Community Benefits & Outreach requested by the City Council b/c of "staffing shortages".

At that meeting West Oakland neighbors requested local jobs & local affordable housing. City Staff basically said they couldn't take the needs of the community into account. (The developer said they were looking at buying more CalTrans land and maybe could put some Affordable Housing there...).

It seems the City Politicians & Administration say their goals are Housing, but in actual practice City Staff & the Planning Commission either can't or won't actually implement it.

Another example of the City of Oakland neglecting services for it's citizens even during a boom economy. This is just one example among many...in Parks & Rec alone.

My sympathies to the animals & employee(s). Ms. Benevidez...as a City employee she should have good medical insurance & other coverage. I hope she's Ok.

PS. If the City doesn't want to pay for upkeep, maybe the Packard Foundation would be willing to help...Especially given Jim Covel's connection to both the Nature Center & the Monterey Bay Aquarium?

What a fiasco. Environmentally & politically. Ultimately this is a result of the City of Oakland not managing it's spending & general fund to prioritize services.

Given this economy, its incredible that the City doesn't have the staff to repair the City Sewer system (much less letting it deteriorate to the point of getting sued by the EPA to begin with).

Though when one looks at the quality of the roads, underfunding Parks & Rec, the historic crime rate, lack of fire inspectors, etc. it seems quite in line with the City not giving it's citizens basic functioning services.

Where is all the money going??? Not services.

One of the interesting things said at this meeting was the Commissioners asking about when rules to include Community Input & Outreach would be added as requested in prior years. Staff said they didn't have enough staff to do it so it's been put on the back burner.

Aside from the issue itself, given this economy, its incredible that the City doesn't have the staff to implement &/or enforce their stated goals or ordinances.
