That is not how preemption works in the U.S. The federal government cannot make the states criminalize activity. The states cannot interfere with federal action, and they cannot be engaged in direct violations themselves (for instance, state-run cannabis farms). But the federal government has not challenged any of the jurisdictions on preemption grounds since the first medical marijuana law passed in 1996.
