The California Cannabis Hemp Initiative of 2016:

 Restores People’s rights to the natural (non g.m.o. only) cannabis plant—both for private use (max’ 99 plants and 12 pounds, no medical card or permit or license or tax needed) by adults and for commercial venues.

 Protects Licensed Physicians from being penalized for recommending cannabis to patients, regardless of age; it also prohibits govt. from taxing “medicinal” cannabis.

 Limits Govt. from regulating, zoning, or taxing commercial cannabis venues in any manner stricter than is applied to California’s beer and wine model. It limits the annual licensing fee to $1,000 and excise tax to 10% of the retail price. It also requires that 50% of tax revenues from commercial cannabis activity be applied to research and develop diverse industrial, nutritional and medical hemp industries in California.

 Prohibits drug (cannabis)-testing as a condition of obtaining employment or insurance; allows govt. to implement a reasonable test for currently ingested (d-9 t.h.c.) cannabis levels—for the purpose of operating a motor vehicle or other heavy machinery.

 Requires the Criminal Justice System to review all current non-violent cannabis related cases, to apply this Act, and to accordingly release from incarceration, probation, parole, modify sentences and amnesty, and expunge records…

 Applies to commercial cannabis venues the same product safety rules that apply to the herbal products industry.

 Prohibits “special” zoning requirements that are discriminatory (against cannabis…).

 Repeals deletes, and expunges any and all existing state and local statutory laws and regulations that conflict with the provisions of this Act. ***THIS IS ESPECIALLY SIGNIFICANT IN THE WAKE OF GOV. BROWN’S NEW LEGISLATION AB266, AB243, and SENATE BILL 643, which effectively will KILL medical cannabis use in California!

 Formally challenges the current Federal Laws regarding cannabis—citing that they are UNCONSTITUTIONAL per the 9th and 10th Amendments of the U.S. Constitution!

'looks like we're down to 2, i.e. The California Cananbis Hemp Initiative (a.k.a. The Jack Herer Initiative), and the Sean Parker initiative. With all due respect to Sean Parker's intent, he doesn't understand cannabis law and has failed to propose what We the People want, which is to liberate a reasonable amount of private use, set up a foundation for commercial venues in the future that will flouorish, and get the fed's off of our states' cannabis rights. C.C.H.I. DOES do all of the above.

The main reason why Sean Parker's initiative doesn't work is that it lets Jerry Brown's legislation stand. (it also fails to get the fed's off...)... Below is my response to an article on his initiative. Please read it so you understand what's going on. If you knew what we avid cannabis law experts know, you would support The California Cannabis Hemp Initiative 2016.

Sean Parker, Reform Ca...: YOU HAVE NOT READ, or you would understand the threats in, Jerry Brown's recent legislation against the cannabis industry. PLEASE DO SO before further, blindly driving uninformed Californians into an ANTI-CANNABIS state!!! Jerry Brown's AB266, AB243, and Senate Bill 643 DO EXACTLY WHAT HARRY ANSLINGER'S "Marijuana Tax Act of 1937" did, i.e. DESTROY the Hemp Industry! It does this by setting TRAPS: First, it mandates so many hoops to go through, no one ever can; then, it fines/jails/blacklists anyone who fails to go through any of these hoops. Meanwhile, it THREATENS Prescribing Doctors that if any cannabis user shows a pattern of drug use, the doctor's career-security will be threatened. Meanwhile, in the Senate portion, it has a TRAP, just like Harry Anslinger's (which is WHY it was declared UNCONSTITUTIONAL in 1969 U.S. Supreme Ct. vs. Timothy Leary) which essentially says, "You know cannabis is still illegal on a federal level. Therefore, all the fines, incarceration etc. we just gave ourselves the right to impose on you, we can immediately impose on you when you apply for any of the licenses we just decided you now need." THIS IS EXACTLY THE TYPE OF TRAP THAT KILLED THE WHOLE HEMP INDUSTRY IN THE U.S. IN 1937, AND WE MUST NOT LET IT STAND!

The California Cannabis Hemp Initiative (a.k.a. The Jack Herer Initiative) would superseded Jerry Brown's cannabis/physician killing legislation. It would also set a foundation of: reasonable private use, commercial cannabis venues without overkill regulation. It also declared independance from the federal level of involvement, presenting the proper legal arguments with which to GET THE FED'S OFF OF OUR STATES' CANNABIS RIGHTS!
