How much will Alameda County have to pay for the "Fraud on the Court" perpetrated in a wrongful judgement of conviction in a misdemeanor DUI case. On Oct. 3, 1991 the California Dept. of Motor Vehicles had issued an "Order of Set Aside" based on the preponderance of the evidence. A Jury was intentionally deceived to avoid all liability for "Deprivation of Rights under Color of Law." Fact - [N]o "accusatory pleadings" or criminal charges were ever filed to invoke the jurisdiction of the Alameda County Courts. Exculpatory evidence (the lack of subject matter jurisdiction) over the defendant and victim was deliberately concealed in violation of Brady v. Maryland. See: Ninth Circuit Case pending since 1996. Alvaro Rodriguez v. County of Alameda et. al., 85 F. 3d 637 9th Cir. 1996. The federal judge assigned to the two related cases (1. habeas case and 2. related Civil Rights case) is being accused with conspiring with the litigants and committing an "official act" consistent with "bribery" amounting to a judicial usurpation of power in the State's criminal case. Ninth Circuit judges are being accused with concealing a fraud on the court. On May 15, 2018 a "Letter to Alert" the Judicial Council of the Ninth Circuit of a "Fraud on the Court" affecting the above pending Civil Rights case was filed. Exhibits of Evidence were presented to prove Ninth Circuit judges concealed a fraud on the court for their colleague who has been discovered with conspiring with the litigants in the above pending sec. 1983 case.

Mr. Alvaro C. Rodriguez has uncovered a massive "Fraud on the Court" perpetrated by officers of the court practicing in Alameda County courts. See: pending Civil Rights case for malicious prosecution: Alvaro Rodriguez v. County of Alameda et. al., 85 F. 3d 637 (Ninth Cir. 1996). Facts - All involved in the Malicious Prosecution and Fraudulent judgment of conviction have been discovered with "Side Stepping" the judicial process and forfeiting the protection of the law to those who work within the judicial process. [N]o "accusatory pleadings" were ever filed by the State to invoke the jurisdiction of the courts and justify a misdemeanor DUI conviction "Ordered Set Aside" on Oct. 3. 1991 by the California Dept. of Motor Vehicles. Verifiable Fact - On May 15, 2018 a "Letter to Alert" the Judicial Council of the Ninth Circuit of a "Fraud on the Court" affecting the above pending Civil Rights case was filed. The Ninth Circuit was presented with evidence to prove a U.S. District judge knowingly committed an "Official Act" consistent with "Bribery" amounting to a "Judicial Usurpation of Power" and a conspiracy to conceal a federal offense for "Deprivation of Rights under Color of Law" pursuant to 18 U.S.C secs. 241-242. The Ninth Circuit was presented with evidence to prove Ninth Circuit judges knowingly acted in violation of Article III sec. 2 of the U.S. Constitution "Cases" and "Controversies" requirement. The record shows Ninth Circuit judges colluded with the State and Ordered a Petition for a Writ of Habeas Corpus closed. The former Chief of the Ninth Circuit issued two false statements # 1. He referred to Mr. Rodriguez as a pro se prisoner. # 2. He concealed a substantial amount of evidence presented with a Complaint of Judicial Misconduct filed on Dec. 12, 2013 Ninth Cir. No. 13-90201. My name is Alvaro C. Rodriguez, I am a victim of fraud and deceit by members of the legal profession and have uncovered a 'fraudulent scheme of public corruption' a 'fraud on the court' affecting Alameda County residents and the American public. Two federal judges are accused with conspiring with five California state judges and other state officers of the court who are named as defendants in a 42 U.S.C. sec. 1983 law suit for Malicious Prosecution. See: Alvaro Rodriguez v. County of Alameda 85 F. 3d 637 (9th Cir. 1996). The Ninth Circuit Court of Appeals is currently Reviewing a Motion to Recall a Mandate and "Set Aside a Judgment for Fraud on the Court" pursuant to F.R.C.P. Rule 60 (d) (3). The Motion was filed on June 22, 2016 case No. 12--15938 Alvaro Rodriguez v. State of California. Extraordinary circumstances of newly discovered evidence reveals: the U.S. district court judge assigned to the above related cases, knowingly and willfully 'usurped judicial power' and deliberately "misrepresented a material fact" on three 'Orders' that distorts the 'Truth' and conceals a 'Key' document. The 'Key' document misrepresented and concealed by all involved is a complaint seeking a 'warrant' that was never signed or issued to support "probable cause" of a public offense. Facts - The "Lack of Subject Matter Jurisdiction" over the defendant and of the state and federal courts has been deliberately concealed by all involved. [N]o "accusatory pleading" or criminal charges were ever filed by the state to justify a misdemeanor DUI conviction. On Oct. 3, 1991 the Calif. Dept. of Motor Vehicles issued an "Order of Set Aside" in this "Notice to Appear" Vehicle Code traffic citation case. On May 7, 1993 the victim ( Mr. Alvaro C. Rodriguez) was convicted. Exposing 'Public Corruption' is an Honorable service. Ninth Circuit status check on July 27, 2017 - the case is under Review and pending. God bless America.
