"Market rates" for rental properties are obscene in the Bay Area. For that matter, so are even the depressed "market rates" for home sales. The working class is being squeezed out of the area, as anyone can see who has lived here for more than a couple of decades. It is unlikely that the jury in this case was dominated by tenants, so if the jury felt strongly enough to render such a large award in favor of the tenants, we can be confident the landlord here was particularly stinky. "Jurors found that Cox had knowingly violated Measure EE, and they awarded each tenant damages for emotional and mental anguish relating to the case. A handful of tenants also received damages for costs incurred in having to move out. In fact, the tenants, one-by-one, had left the building as the case dragged on; only one resident remained by the time it ended." Now the appeal proceedings begin, the paper chase continues, and the landlord has his (nearly) empty building. It may have cost him too much, but his apparent aim of presenting a multi-unit property to the market, free of encumbrances like affordable housing contracts, seems to have been achieved.

Recent letters to the editor indicate some might view the tragic and preventable drowning death of Dr. Zehra Attari as nobody's fault but her own and, therefore, worthy of no further consideration by responsible people. Such views are insensitive and short-sighted. One writer even takes the now deceased Doctor to task for probably being "a disoriented driver." [!?] Although the area was posted with warnings, the fact that her death was recently preceded by the untimely death of two young men who met the same tragic fate, at the same spot and in a similar manner, furnishes prima facie evidence that those roadside warnings were clearly insufficient to prevent this preventable repeat tragedy. Who among us hasn't inadvertently blown a stop sign from time to time? While intersections are many, marina landings like the one in this case are rare and therefore less costly to supervise, but the consequences of inattention are if anything more deadly. Speed bumps or gate mechanisms are readily available and relatively inexpensive to install and maintain. Thousands of railroad crossing arms furnish yet another example of the simple remedies available to prevent other drivers from paying the ultimate price for momentary innattention. The City of Alameda had ample warning that this tragedy could be repeated, and ample means to prevent it. What happened to Dr. Attari could happen to anyone of us. Will it take the death of child passengers before the City administration takes responsible charge of the situation?
