*Seems completely reasonable for bidders to decide not to compete with each other on the courthouse steps. It's a cash sale with bidders showing up with hundreds of thousands of dollars in cashiers checks. If no other qualified bidders show up on that day the remaining bidders have the discretion to do whatever they want in regards to bidding or not. After the sale the winning bidder also has the right to resell the property publicly or privately.

I live in an old apartment building in Oakland, the landlords are a married couple who bought it in the 1950's. After 12 years my rent has gone from $1100 to $1350. They could have raised it much higher. I asked them one day why not and they basically said they didn't need any more money. Shame on the greed-heads who have no problem kicking out poor people, the people who clean their toilets and wash their car and nanny to their kids. Heartless.

I would be pissed off if someone sold fruit in front of my home. Don't blame the caller for reaching out to get him moved. And if he won't willingly comply than an arrest is warranted

This is the way the court step auctions always have worked. Bidders agree with each other "Don't drive the price up on me for the property I really want and I won't drive the price up on the property that you really want."
Seams completely reasonable.

Look, I have several of these people in my neighborhood. I view them as an asset... Fruit stand right there on the corner.

But I also ponder, how does she stay stocked? I've seen a fruit truck drop off a load to restock. Where does she come from... Is she labor trafficked? No way to tell and she's not selling sex so no one will ever look into it. I've seen her there when I left in the morning with a small kid... She and the kid are still there when I get home twelve hours later. WTF! That has to be hellish for her AND the kid. At five dollars a bag, how can she possibly be making a living... Only as a part of something much bigger. Wait... she never charged me sales tax. Something bigger, organized (possibly a human traffickers) uses her and her kid as a front to operate a business that neither collects or submits sales tax. And that was a BIG truck. A lot of fruit on it. And I'm betting the bigger thing relies on community outrage over enforcement to fly under the radar.

Hmmm... It MAY not quite so simple and harmless as it looks, eh?

That's ok... Now you feel good. You protected the little guy... While allowing the big, hidden something to thrive at their expense.

This A$$hole did this to me, I ended up taking him to court. He commited perjury in small claims court, but the judge asked me just to take the check instead.

He filed multiple illegal evictions against me and tried to harass me to move out.

The police respond to complaints. They are supposed to. No reason to blame them for this when it was us. We operate a non-profit that defends the rights and resources of native born californians. the majority has passed laws to require permits to sell food, and when someone violates those laws they compete unfairly against the people who live and work in this area who do follow the laws. We made the complaint. Blame us if you like, We do not blush or shrink from our task. Serving our constituents is our job.
We are Save Our State, and we make complaints about similar activities every week to serve our community. The police are obligated to respond. Normally it would be the health department, but they are not equipped to confront often hostile people who work under the table. So they pass the job to the cops.
If anyone else needs help with unlicensed, unlawful foreign competition in their communities in this state, we are here to help you

Jim Mzt, I agree, the man is violating a noncriminal law, an insignificant ordinance that can be enforceable with a warning or a citation, not an arrest. He was simply low-hanging fruit for the cops to justify an arrest, in my humble opinion.
Does it even occur to you how much time, manhours, tax dollars and effort it takes to arrest and book a person into jail ? Is this a good return on our tax investment to go after low-level infractions, non-violent, non-criminal, non-felony, instead of investigating patterns burglaries, robberies and significant non-violent offenses?
To illustrate my point further, if a cop chooses to let you (a privileged and educated person) off with a warning for speeding or talking on a cellphone when driving, should you insist on being arrested for violating the law? Law enforcement has the discretion to arrest or not to arrest someone based on, OK, will this person be a threat to society for violating the law? Will this person start gravitating into organized business crime because he's selling fruit unlawfully on the sidewalk and not from the back of his car trunk so he can make a quick getaway?
That poor man is hardly a threat to the community. He's relatively poor and uneducated, trying to earn a living the best way he can without being a burden to the rest of us. He probably doesn't even know the law on selling on the sidewalk or if he's unfairly competing with Safeway or the Farmer's Market, jeez.
In all, he was targeted, because he was low-hanging fruit...an easy police report, just add belligerent behavior in writing because it may be just too much "hard work" to deal with other real crimes in the neighborhood. Too bad there wasn't any video for us to evaluate it further in the court of public opinion.

Interesting that kids selling lemonade on the corner isn't a crime, but someone supporting probably said kids selling fruit that made lemonade is a crime. Maybe he should've sent the kids instead. What thee entire fux is wrong with people?

I ride a bus that stops in front of the Bank of America in San Leandro. They usually have a security person in front of the bank. However, most of those who ride the bus are elderly and disabled. I have not seen anyone loitering as there is no place to loiter. What causes loitering are corner and liquor stores. Oakland get a back bone and restore the bus stop.

There's a lot murders in Alameda county to waste time arresting a person who is trying selling food to bring food to his family. Anyway is not a crime to sell veggies and fruit, by the way how many strawberry the sheriff's department bring home that day?
