This highlights the problems faced by State Legislatures attempting to quantify illegal levels of drugs in drivers. Nearly every State makes it unlawful to drive under the influence of drugs and/or alcohol, this leaves the determination of whether a driver is under the influence to the investigating/arresting officer and then a jury of the driver's peers. The determination of whether a person is under the influence is a subjective decision. Quite simply put, many drugs, prescription and illicit create tolerances in the persons taking them whether recreationally or under physician supervision, specifying a quantitative measurement as unlawful may make some drivers illegal despite being unimpaired by their drug use.
