If the dept. Of health San Francisco is requiring dispensaries to obtain proof of California residency prior to distribution, any person denied access should file suit. The Supreme Ct. Cali. already stated cleary in People v. Kelly that the legislature of Cali. has no ability to alter in the slightest bit the orders given in the people's referendums. Since the CUA does not require residency any requirement by any government office is in violation of California law.

There was an actual ruling on the non resident issue several years ago. Can't find the case at the moment, but during a raid on a Mendocino garden in 2008 the sheriff found 1 individual tending to the garden who possessed an Oregon license. The sheriff arrested him because they believed at that time that a non resident couldn't acquire a recommendation and use medical marijuana. Person was charged for possession and cultivation and court determined that he couldn't use a medical defense because he wasn't a resident. Appeals court reveresed saying all people, resident or not, have the right to use medical canna.

“We are not recommending maximizing the amount of tax revenue, we are not recommending that we promote and create a large industry, and we are not promoting and recommending the price of marijuana drop significantly."

In other words, "maintain the current status quo, and maybe even go backwards, as much as we possibly can"; and not because of any specious concerns over usage rates--data from Colorado has already shown the only people buying weed who weren't before are tourists--but simply to protect the wealth and power of those with vested interests in cannabis prohibition, especially law enforcement.

Research, including clinical trials, has to be done in order to get FDA approval. With FDA approval, we could have it covered under our health insurance like other drugs.

The downside (in my eyes) to that, is that pharmaceutical companies will soak us for many $$$ with their patent rights. Then, we'll start buying it on the black market, again. :)

The reason there are so many obstacles to medical marijuana research is that the DEA's budget and the whole premise of the war on drugs would be called into question once medical applications for marijuana are established and recognized. It's all about money and the corrupt power vested in the Drug Enforcement Agency, the most rogue agency in the DOJ.

It is a MORAL IMPERATIVE that Medical Marijuana be immediately legalized in all 50 states.

Ask any American Cancer patient who's gone through Chemotherapy and used it. Ask the parents of any American kid with a seizure disorder who's life its saved. Ask any Veteran who's used it to relieve their PTSD symptoms and make life worth living again.

We need the President to cut through the red tape and take personal action on this issue right now. We need congress to pass the CARERS act too. Americans are suffering and dying -- needlessly!

For Cancer patients, for kids suffering from Seizures, and for so many others, safe, legal, access to Medical Marijuana is a matter of life and death

Please call the whitehouse comment line at (202) 456-1111 and email the President by going to whitehouse.gov and clicking on "contact us", and ask that the President have Marijuana removed from Schedule 1. Call and email your Senators and Representative as well and ask that they pass the CARERS act immediately.

Call and email them every day, and ask everyone you know to call and email every day, and to keep calling and emailing, for however long it takes, until the President, Congress or both take action. Please do everything you can to get as many people as possible to call and email, and keep on calling and emailing, every single day.

Please do everything you can to help with this effort.

With luck the effort will go viral.

The lives of countless Americans depend on it.

Oh those brave, insightful senators!

Taking on the drug policy establishment!

Just think, only a few million poor folks jailed for associating with a joint.

Meanwhile states like Washington and Colorado a couple of years ago threw the whole drug war/prohibition nonsense right out the window.

And those states were a couple of decades too late!
