Okay folks, let me bring you ALL up to speed in these matters! If I told you that 99% of all the entities currently operating marijuana businesses in California are illegal for-profit corporations known as "dispensaries" holding themselves out to be lawful "collectives" or "cooperatives" you'd probably be shocked. Yes, that means NOT one of those unlawful entities is following current state law as its NOT protected by the spending amendment! The SBOE would have a list of these "sales" tax exempt entities on file and on record because you simply cannot "sell" or "profit" from a controlled substance or the transactions. Nowhere in current state law does it say that you can specifically "sell" or "profit" from marijuana and our state government has misguided us into unlawful activities simply so they could tax the illegal business operations. Furthermore, the spending amendment does NOT address or effect the long arm of the federal government known as the IRS and they're ability to enforce federal laws like the CSA, RICO and their own Rule 280E. The "paper shield" amendment only has four corners and only says what it says inside those corners and nothing outside or beyond that is protected from federal prosecution. Rejoice if you are one of the rare handful of lawful entities operating today and be very wary if your NOT because the federal government knows California mislead you from the get go so they could "Cash in on Our Use" if you're not smart enough to understand and follow the "Compassionate Use Act" the way its supposed to be followed in conjunction with federal law! The fact you paid "sales" tax is the very evidence that will be used by the federal government to prove you weren't following state law and will also be the evidence used to prosecute you and or your organization. I wish the best of luck to ALL those that believed the "dispensary" business model used by even the largest of operators is exactly what comes back to haunt you and shame on California for leading you down the unlawful path and the potential prosecution simply for the "taxation" of illegal business activities of "selling" and "profiting" from pot!

A lot of people who live in Nevada have California marijauna medical cards but not California State Issued cards. A person who resides in NV can not get a Ca state issued card. People who reside in NV get these cards from Ca because it is cheaper, less of a wait and California Cards are not obtained at the DMV. Nobody wants the police to know that they have a medical marijuana card. If a cop pulls you over for any minor violation and checks your dmv record then it is quite possible for that office to administer a DUI test and take you to the hospital for a blood test. Considering the 2ng law a person might be charged with a DUI even if that person is not under the influence and had not smoked for a week or two. What is safer for a person living in Nevada who has to drive some times. Getting a Nevada mj medical card or a California mj recommendation?
@Dave Armstrong: Gonzales v. Raich took *three years* to wind its way through the court system before it *lost* in the SCOTUS; assuming your lawsuits even get that far--and many others have tried the same route and failed--that's still at least 15,000 people busted for weed *per year* in California alone until the case is *even heard*, because there are no "right now" (!) shortcuts; and if the decision goes against you--as it very likely could, given the court's current and probable future makeup--then what?

Less than *three months* from now, we can *definitely* end the prohibition of possession, cultivation, sales to, and use of cannabis by adults not only in California, but Nevada, Arizona, Maine, and Massachusetts, plus medical use in Florida, North Dakota, and possibly even Arkansas; if that happens, nearly one out of every four Americans (23.5%)--at least the adults--will be *free* of the threat from prosecution for their personal possession and use of cannabis, and well over half the states will allow at least some kind of medical use. At that point, the obstruction to reform in Congress on such issues as access to banking, federal tax equity, and scheduling under the CSA by corporate prison and LE tools or prohibitionist relics like Feinstein and Grassley will become increasingly untenable.
How about this: you keep working on your "front" with your magic-bullet lawsuits and blogs--which nobody from the pro-64 side is working against, right?--and let those of us with a more pragmatic and *proven* strategy--and sans an existing vested interest, BTW--continue working on ours unhampered by the unfounded fear and disinformation tactics from you and your cronies in the "215" weed industry; fair enough?
Appreciate the offer for a personal dialogue, but we prefer to discuss the issue in a *public* forum, where everybody can view and weigh the arguments for themselves.
Also, just a piece of honest, well-intentioned advice: you might want to check out this thing called a "paragraph break" ... !
The plan is to take this issue all the way to the Federal Supreme Court if necessary right NOW! Why wait till the pot boils over (excuse the pun) and people's livelihood and assets have been put in jeopardy! Just as people are made to believe that putting the cart (state law) before the horse (federal law) and making cannabis quasi legal at a state level while federal law enforcement entities like the IRS simply look the other way is ridiculous and a pipe dream ( another pun) my fellow marijuana smoker. It's as simple as this my friend, always ask for permission (from the Feds) rather than forgiveness in federal court later...right?! I'm not trying to spread a campaign of "fear" but rather an individual who's a champion of "truth" seeking justice and educating the public and the people of the facts in this matter! I'm in the process of launching a blog to just that, educate everyone as to my personal experiences and hands on knowledge of this industry so that we ALL don't have to go through the marijuana business mayhem and madness that exist in the real world today. Rather than taking a negative attitude and saying defamatory statements about people and organization you simply know nothing about I highly suggest you open your eyes and actually see the writing on the wall and do what's necessary. I have several lawsuits filed in order to bring these various matters involving marijuana to light and in order to educate the public of the major problems that exist in this business and the industry as a whole. We need to ALL join together, look at the facts and the truth and actually do something about it before it's too late and the rights and freedoms we ALL should have to grow and produce our own medicine from a natural plant put on earth by God are taken away by our own government and the corporation that want to control, regulate and tax cannabis. Wake up Miles and smell the marijuana and what the capitalist cannabis conspiracy is trying to do by misleading and misguiding people who chose to use marijuana as their personal choice of medicine for whatever reason. Cannabis is not the new cash cow for corporations and our governments simply because a smaller percentage of us choose to and use marijuana rather than alcohol, tobacco and prescription drugs. This is truly a matter of common sense and knowledge of the facts surrounding the stigma created many years ago to stymie the most productive plant on the planet! As for "thousands of us to potential slaughter"--hyperbole much?--over 15,000 people *were* busted in California for weed in 2015, a number which will drop by at least 80%, based on the experience in CO and WA ...
So what's *your* solution; wait another two years (30,000 more busted) or four years (60,000 busted), or maybe another twenty (300,000 busted) for the "perfect" legalization that you "215" profiteers somehow never seem to be able to even get on the ballot?
The only ones facing a "loss of livelihood" are you and the other so-called "non-profit collectives", which is why, other than the cops, corporate prisons, and pharma and rehab tools like S[c]AM, you're the ones spreading all the fear and disinformation.
Marijuana consumers deserve and demand equal rights and protections under our laws that are currently afforded to the drinkers of far more dangerous and deadly, yet perfectly legal, widely accepted, endlessly advertised and glorified as an All American pastime, booze.

If you want to truly discuss misleading information and deception and consumer protection then explain how Prop 64 and recent legislation (MMRSA) can turn federal law (CSA) and current state law (Prop 215) completely upside down. If you're really concerned with violating federal advertising laws and kids then the fact that anyone having anything to do with marijuana faces federal enforcement and potential incarceration from the IRS! So when the state, county or city you live or operate in ask you to make a "sale" and pay "sales" taxes your setting yourself up for disaster and will be out of business just as fast as you got into business. This is a travesty of justice and an outright lie being fed to Californians just so they can turn the "Comoassionate Use Act" into the "Cash in on our Use Act" and fill state and local municipalities coffers with cash from cannabis. The state, county and city governments cannot and will not protect anyone from the long arm of the IRS and Rule 280E or the potential of criminal charges and imprisonment! DINO or not, there's not much progressive about the Democratic Party. If anything at all.
Feinstein is more like a dinosaur than a DINO. Her ideas are ancient and tend towards violence and repression far more than civil liberty or rights.
In addition she's definitely a one percenter, filthy rich and very out-of-touch with ordinary folks.
What facts are these authors (not so-called) withholding from the public? Who do you know is intimately involved with medical marijuana and not aware of the very real dangers that are present from just growing/handling what is still a Schedule I substance? Why exactly are you so angry? Have you spoken to any one of these authors?

So let's put this question of "reciprocity" in another light and use the right to bear arms (2nd Amendmebt) as an anology. Let's say we were talking about guns and the right to carry a firearm, if I buy a gun and follow the laws of the land and someone else goes further wanting to aquire a concealed weapons permit does that give the permit holder more of a right to gear arms? A larger percentage of individuals don't go the extra mile and request or require a permit to do what is a civil right when they wish to protect themselves so why should an individual who has the right to choose what kind of medicine or product they want to ingest or enjoy have to go the extra mile and get a permit or special permission in order to do so? Just say'in that we all need to stop the madness and stigma placed on marijuana by our government and corporate capitalist from the 70's and look at the facts and the future of camnabis, a plant put on this planet by God for a purpose and s reason!
Think about it and think outside of the media and government controlled box!

I have never seen such a blatant attempt to profiteer from the ignorance of medical patients than these so-called authors and individuals putting everyone's livelihood in jeopardy because they won't and don't tell the truth and the facts to the people! Until the IRS says you can "sell", "grow" and "profit" from a controlled substance NO one is safe and everyone will be sorry when the Federal Tax Man comes calling or audits you! While these individuals proport you to blatantly violate federal law without explaining the risks and potential of prosecution and the loss of your assets and livelihood by having to spend ten years to life in prison is preposterous. The fact is plain and simple folks, anyone having anything to do with marijuana can't avoid federal law and the IRS, DOJ & DEA! This is good . No cards from other states should be allowed at all! Especially California where anybody can get a medical card for just about any reason. You can even say "I need to use marijuana or else I'll be sad" it's a joke.
It's the same as going to Mexico , getting a prescription then expecting America to fill end .
That's "fewer than 100,000 cards" since *the program began* in 2004; since 2014 less than 10,000 cards, which are generally valid for only a year, have been issued ...
Although obtaining one can be a hassle and expensive [http://goo.gl/V5wfCj], they are worth the trouble, as they offer the closest thing to a "bar to prosecution"--vs merely an "admissible defense" from a doctor's rec--for patients and caregivers: If a police officer detains a cardholder for having weed, the cop must, by law, call the phone number on the county–issued Medical Marijuana Identification card and recite its ID number. If the card is real, the officer must release the cardholder. Under California law, police can't even ask an MMI cardholder questions about the marijuana in his or her possession. In fact, an officer faces a misdemeanor if he doesn't respect the MMI card, due to provisions of medical privacy mandated by the federal HIPAA law and supported by state Senate Bill 420.
Keep in mind there will still be room in the prisons & Rehab centers for those whom have substance abuse problems. And then those that fall outside of societies norms will end up in either place. The fact that nicotine, alcohol & various hospital errors kill a large number of people each yr ( CDC REPORT FOR '14 most current stats). No 1 that I've seen can tell me why Methamphetamine is a sched 2 drug? Cannabis needs to be made available to those whom need it(in this instance a medical avenue) its also apparent that the folks who currently grow for medical receivers need to continue & to educate the general public. Its quite scary in the fact that the govt could stomp in at any time & destroy what those who are in the production end of this business model. If the govt was really wanting to help us, they would make nicotine illegal. Instead of subsidizing the tobacco farmer lets retool their industry to aid them in the growing of medicinal cannabis. The govt does not oversee the making of supplements, which have also done its fair share of harm to the public(also CDC stats) there has to be a reasonable ground for all to share in. The problem is the 'reasonable' heading. Vote out those that do not follow the wishes of the constituents. Its already started, it needs to continue. My expectations for reasonable medical care have at times been very cruel & unusual; all in the name of m3dical practise. I just wish my physician had the ability to Rx cannabis: I have no idea if i would benefit or be harmed by its use and various components? I do know as a spinal cord injured person; I want & need a better way to address my neurological problems along w/pain-discomfort created by a spinal cord injury. Not asking for the world, just a desire to be actively involved in this world.
I am so sick of these old codgers being jealous of young people and hoarding beach properties to keep young people out and bashing marijuana users. If they want to live in an anti marijuana place, then they should move to some redneck corn fart state up north. Florida is the tropics and meant to smoke marijuana in. Furthermore, state leaders are complete morons by keeping it illegal, because they would make huge amounts of tax dollars if they legalized it. i have spent most of my life living in the worst nieghborhoods in tampa,fl. through this time i have helped many poor and impoversed people, many mentally ill people, and many people who just can't get it anywhere. i remain poor too with little to none assets also but my joy and reward has been knowing that i have helped such people. i have bipolar schitzo effective dissorder for the past 18 years of my life and no matter what any doctor politician or the lying wealthy, marijuana helps us too. in their ignorance they will say mentally ill people won't be included for medical use. mentally i'll people account for a very large amount of pharmacudical drugs which do help for the benefit of the mentally ill. mentally ill people struggle and are bassically outcasts of society and trully have no voice in this matter either. their lives are filled extremely with derision and too much emotional pain also. marijuana has helped us all with this pain and it frees our minds bodies and souls. mostly they can barely afford it. so i dedicated the last 22 years of my life to help my fellow poor and ailling brothers and sisters in my community. i have no finnantial gain from it all, but i am still poor also. i am rich in the fact that i have helped all who i have through 3 dollars five dollars and the occasional ten dollars. too many injustices against the poor from the oppressive wealthy. there will be a revolution against these injustices because one day we won't take it anymore. our american ancesters revolted against slavery and houndred of years earlier revolted against the spanish english an other nations that still exist to this day. in europe we fought against the oppressors and people of power. africa pronounced slavery for thousands of years. we must fight back and fight these present day injustices and we must regain what we know as human beings to be right and fight against wrong or we are just as guillty as the oppressors themselves. we as americans just look the other way like people who witness murder and say nothing at all. how long will these injustices remain? untill we the people of the UNITED STATES OF AMERICA, WE THE PEOPLE FOR THE PEOPLE STAND UP AND DO WHAT IS MORRALLY RIGHT AND RID OUR FUTURE OF THESE REOCCURRING WAYS. Of course, the "old Guard" republicans in Michigan, have pulled out all the tricks they could and have silence the voices & will of the citizens in Michigan. The Kingdom has put the kibosh to a rec. marijuana vote. (for now only - it will be back)
