And once these ass-hats come down on the guy so do the rest of them. Then it's not just one lisencing fee. From my understanding ASCAP doesn't own rights to all music. So now businesses are left to pay what? 1 or 2 other companies another fee? So Jay-Z and LMAFO can profit? Maybe I'm speaking from ignorance but these folks seem like exporters for self profit and the big artists stay rich. I never hear about how many small less known artists get help from these guys. Correct me if I'm wrong but ASCAP is a bunch of ass-hats coming down on the little guys. You can't play music in a cafe unless you pay these outrageous fees that small business can't afford and then you're out of business when they sue you. if they were keeping big venues in check I could understand that but these guys are being bullies and picking on the little guys.
Having managed a few places I know the rules and this guy hasn't a leg to stand on. He is out and out stealing from these artists for his own personal gain.
"We don't like to litigate," said a person who has the word "legal" in his job title. I think ASCAP's case is pretty strong here, but Mr. Wagener is being disingenuous at best with his "Aw shucks, what a shame we had to file several lawsuits" routine. Lawsuits are the reason why ASCAP employs him, and they're clearly a litigious organization. Let's call a spade a spade.

Why is it on the venue to get licensing rights and not the DJ who gets paid to play the songs?

I was at Leo's the night Double Duchess performed and I was completely blown away. I didn't expect such as awesome act to open in a tiny club. They were so fabulous.
