Teens Will Be Tried as Adults in Richmond Rape Case

Robert Gammon —  Fri, Oct 30, 2009 at 10:45 AM

Three East Bay teens allegedly involved in the unconscionable rape of a 15-year-old girl in Richmond last weekend are being tried as adults, meaning they could face life in prison. If the three young men were charged and convicted in juvenile court, state law requires that they would have to be released when they reach they age of 25. The young men are Ari Morales, 16 and Cody Smith, 15, of San Pablo and James Peter, 17, of Pinole. A fourth defendant, Manuel Ortega, 19, of Richmond also is charged in connection with the case, and could face life in prison.

The alleged gang rape has prompted "expressions of outrage from all over the country," said prosecutor Dara Cashman, according to the Contra Costa Times. Cashman cited the "coldness" of the alleged gang rape for why her office decided to try the teens as adults. The case has grabbed national headlines, particularly because the young men allegedly laughed during the two-hour attack, while many other teens walked passed without reporting it. Two other suspects have also been arrested in the case, according to the Times.

I don't have a problem with swift and severe justice for the majority of those involved but I have misgivings as to whether James Peter was involved.
Supposedly he is a good kid, no disciplinary record, no arrests, good grades, and he says he was just passing-by.
I know, that's what he says.. but I'd like to have seen a grand jury hearing for Peter, to show there was enough to establish that he was not just a passer-by.

Is it true that he was the only black guy around?
His arrest seems suspect.
Just for the record, I am white and work with enough cops to know he could have been innocently arrested just because he was the only black kid around.
Another problem I have with Peter being arrested is that, at least in Southern Cali, the blacks and Hispanics don't hang out.
They only associate with each other when they are fighting/killing each other.
Not to mention that good students generally don't hang out with low life gang bangers.
I have a tough time believing that these were "his peeps" and that he was hanging out with them.
Remember, it was a dance, there were a lot of people there.

The rest of them can burn but I want to see more of what they have on Peter.
Otherwise, where he is concerned, it seems like another Duke Lacrosse public relations arrest to me.
"Round 'em up quiick so the plebs won't revolt."
People are pissed and I'd hate to think someone innocent will have to go through the process for something this big just because the DA rushed to quell the masses.
I just want to know that there wasn't a rush to judgement with regards to James Peter.

I fel bad for the girl but I also feel for the dad, trying to call his daughter while she was being raped just a few hundred yards away.
And he was probably pissed because she wasn't picking up the phone....

I strongly support the death penalty for cases like this.
These guys are worthless to society.
If it was my daughter, I'd meet all their parents in a dark alley, one at a time with a baseball bat, for raising such scum.
Of course, I am not suggesting anyone do such a thing but I use that visual to illustrate how this enrages me.

SillySally is more than silly...she's deluded. To think that it 'never happened' twenty years ago in middle class Southern California shows how oblivious most people are to this crime. I have worked with a rape crisis center in a middle class Southern California area for more than 20 years, and can tell you that attacks such as this are not uncommon--the only difference is that this one resulted in headlines because of a 911 call. Usually there is no one to intervene or seek help, and often the victim may not report to the police and only contact centers such as ours months later for counseling assistance

Contrary to SillySally's delusions, white males can be-and are- rapists as well, and have participated in attacks just like this as well as other, more insidious rapes where they can hide behind their white middle class privilege. Don't tell me you never heard about the gang rape committed - and videotaped- by white males, including the son of a high ranking southern California law enforcement officer a few years ago. It was nearly successfully covered up, thanks to daddy, but it too finally made headlines.

If your daughters were honest with you, SillySally, they could probably tell you stories about rapes they know about committed by their white male classmates; but they won't tell you because they are continuing yiour legacy of delusion. Only now
their list of people to blame has probably expanded from hispanics, blacks (and Armenians ?) to include the victims as well. It's easier to keep up the facade that rape doesn't happen in your pristine area of paradise if you go along with everyone else and pretend that people you know couldn't do something like this--even if that means you let other people you know, like the girl who "wanted it" or "deserved it", take the blame.

how cold - all these teens probably had a cell phone on them and yet didn't dial 911 and how cold to see one of the rapist's cousins weeping for the cameras and stating her rapist cousin is "innocent" - no your cousin is an animal who needs to be behind bars like all the other animals...

This behavior as described above certainly is not the American culture that I experienced as I grew up in Southern California in a middle class area 2 decades ago and how it mostly is now for my daughters. Back then, the conduct described above simply never happened. Now, it happens in the areas that are predominately Hispanic or Armenian. Never amongst areas that are mostly white Americans.

What a poor set of circumstances, freedom for American women mixed with modern pop culture and unwed mothers raising young animals. Added to this deadly mixture is the low regard of women by Hispanics, Armenians, and blacks. A world without gangs was once the norm throughout almost all of California, now area after area is turned into a cesspool such as Richmond,

As a mother of five children - four daughters and a son - I can tell you that girls simply have no choice at all of cultivating a sexual side to themselves. No choice at all. I resisted this choice with all my heart as a young girl, from the days at 12 when it became impossible for me to go to the movie theatre, even with friends, any longer, because boys my own age and up insisted on aggressing on me, putting their hands on me, and generally treating me like a toy. My daughters have resisted becoming too sexual also - and have been pressured, mistreated, and insulted the same as I was. I could never blame any female, girl or woman, for giving in to the gross mistreatment and insults leveled at any and all females who resist allowing boys and men to insist that being female means being sexual, and sexually available.

Otherwise, I agree with the above comments. I agree that boys and men show disrespect for just about everyone. Yet I think at the bottom is the disrespect toward women, not the other way around. I also agree women dress and think too sexually and too much like slaves. Yet where I disagree, as I described, is that any of this is the fault of women. Women are pressured unbearably to be sexual. The problem the world has is - what to do with men. Freud asked the question - what do women want? I've long said there is a simple answer to that. They want freedom. The real question is - what do men want? And I think there is an equally simple answer - they want to play dominance-submission games. That is what they would do if in their own society without women. That is what males do. That is what nature intended for them to do. Nature intended for women to raise and nurture children, and eventually design civilization. Nature unfortunately did not include males in this plan. What can 'we' meaning - women - do about this? I have no ready answers but I do know that men are simply behaving like men when they bully and dominate.

Inasmuch as the males (I can’t call them boys; they are too old, and of course they are not men) exhibited total disregard for a young woman, I feel it goes much deeper than that. I look around and see the type of behavior some people have nowadays and it bespeaks of disregard for ANYONE; parents, teachers, law enforcement, the judicial, system, etc. Anyone; male or female, who knew of this horrific event and did not report it (everyone has a cell phone or access to one immediately!) simply showed zero respect for humankind.

Yes, we have a society where too many women defer to using their sexuality to get what they need; attention, grades, money, position, etc., coupled with too many males seeing females as sex objects. Both genders are disrespecting themselves and each other. And too many girls feel they can get what they need by being cute. By the time they hit High School, they have it down pat. We’ve all seen them in action. Even as they get older.

I have been a single Dad for 18 years now. 2 children; my daughter is 24 and my son is 21. I would share the same example as a warning to both. I would tell them that it is amazing how often I will be speaking to a woman and yes, at one time she may have been very attractive, but the problem is her intellect stopped when she began to use her cuteness/sexiness to get what she needed. Now she is (like all of us) getting older and less comely. Problem is, her education stopped so long ago that she is now faced with accepting far less than she should have. If she’d only paid attention to the inside of her head while she was preening the outside
