The California Supreme Court agreed yesterday to hear arguments challenging the constitutionality of Prop. 8, but refused to let gay people wed while the case is pending, the Chron reports. At issue: whether the proposition so denies individual rights that it can only be put on the ballot by two-thirds of the state legislature; and whether it "violates the constitutional separation of powers by limiting judicial authority." Justice Joyce Kennard, who voted with the majority that banning gay marriage violated the constitution's equal protection clause, voted against hearing the case, which means she's likely to rule that the proposition passes constitutional muster. Which means Prop. 8 is probably here to stay. Meanwhile, backers of Prop. 8, not satisfied with banning all future gay marriages, have asked the courts to retroactively invalidate those that were consecrated before Election Day. No word yet on whether they're planning to kill a few puppies while they're at it.

the voters of california have voted on the issue not once but twice. The people of california do not want this. It is not an issue of respect, or thinking you are not equal. You have CHOSEN a life style that the people of california do not support. I am sorry that you think it is a god given right for you to be married. God did not, in any religion, sanctify marriage unless it is between a man and a woman (born as a man or woman). You may love that person, you may be friends with that person, but I am sick of this thought that it is ok to be gay. Our communities grow up listening to that and our children begin to tolerate it. I have had enough.
Sadly, after fighting a losing 35-year battle on abortion, the religious right feels comfortable attacking a strong, proud and often-vilified minority. That bigotry ruled Election Day when barriers were broken fills me with an agonizing pathos. The realities of American life often fall short of our dreams. Throughout our history, the majority of Americans have often targeted different minority groups for discrimination. I have always stood against discrimination and have devoted my life to diversity issues.
As a 46-year-old woman who is one half of one of the 18,000 couples who was married in California prior to the passing of Proposition 8, I understand that the government recognizes me a lot when it cashes my tax check. However, I will no longer be your gay friend, America, until you honor the rights that our founding fathers and God gave me, too, through the Constitution. You have no right whatsoever to force me to follow your religious doctrines, especially when it violates my religious freedom as an American. The attacks on my wife and me through your obsessive, ongoing lawsuits and discrimination are products of your religious moral dilemma that would be best solved by holding marriage counseling groups for your parishioners with marriage issues. The sad reality is that a large religious organization outspent the gay community and got their ads out first. We protest this decision. We need to educate you, supporters of Proposition 8, about a simple thing called love and a brilliant document called the United States Constitution, especially the section that begins All men are created equal
. While I will respect you even when you dont respect me, it is not over.
We the voters of California have spoken with our vote. Government; This feels like betrayel. You are allowing this group to strong arm you into hearing an issue thats already been decided. what if the yes voters started protesting. You would have an all out war between (good and evil).
